Judge's Medicare Advantage Order Could Have National Impact

medicare-logo-png_76289_20130416-356On November 19th we reported on notices having been received by United Healthcare Medicare Advantage physicians in several states informing them they were to be dropped from the Medicare Advantage network. It has been reported in Kaiser Health News that a Connecticut federal judge with jurisdiction in Fairfield and Hartford Counties has issued a preliminary injunction blocking United Healthcare from moving forward with these terminations.

U.S. District Court Judge Stefan Underhill cited the strategy being used by United Healthcare to unilaterally amend the provider contracts to remove physicians from ONLY the Medicare Advanage network, leaving their commercial participation intact.

This ruling will be closely watched by CMS, state medical societies, hospital systems and physician groups across the country.
